PERQS Member LLC, its subsidiaries, affiliates, and other third parties acting on our behalf (collectively “PERQS Member,” “we,” “our,” or “us”), respect your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect your personal information when you visit our website PERQS.com and other related websites (“the Site”).

This Privacy Policy applies to personal information processed by us, including on our Site, other online or offline offerings and communications, and through other platforms and programs that link to this Privacy Policy.

By accessing or using the Site, you agree to the collection, use, disclosure, and retention of your personal information as outlined in this Privacy Policy. If you do not agree to this Privacy Policy, you must cease using this Site immediately.

1. Personal Information We Collect

We collect the following personal information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you, when you interact with our Site:

• Referral Source: We may collect information about how you found our Site, including the referring company or affiliate.
• Transactional Data from Users: If you make a purchase or engage in any transactions through our Site, we may collect transactional data such as the items purchased, the value of the transaction, and payment-related information.
• Transactional Data from Referring Companies or Affiliates: We may also collect transactional data from the referring company or affiliate associated with your referral, including data such as transaction history, transaction value, products purchased, payment history, and any performance-based metrics. This data may be provided directly by the referring company or affiliate or through referral tracking links.
• Third-Party Services and Sources: We may collect personal information about you from third-party services and sources, which may include advertising networks, internet service providers, data analytics providers, government entities, operating systems and platforms, social networks, and data brokers.

This personal information is provided by you voluntarily when you fill out forms on our Site, such as signing up for an account, subscribing to newsletters, contacting us through our contact forms, or completing a transaction.

We may also collect other information about you, such as your interactions with the Site, which may include, but is not limited to, browser and device information, data collected through automated electronic interactions, usage data, demographic information, geographic or geolocation information, statistical and aggregated information, and other Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information collected via online tracking technologies, such as cookies, pixels, etc. (see Cookies and Tracking Technologies below).

2. How We Use Your Personal Information

We use the personal information we collect about you for the following purposes:

• To Provide Services: To respond to your inquiries, process orders, or provide customer support.
• Marketing Communications: To send you updates, promotional materials, and information related to products or services that may be of interest to you. You may opt-out of receiving marketing email communications at any time by following the unsubscribe instructions in the email.
• Referral and Transaction Tracking: To track referral sources and credit the appropriate referring company or affiliate for transactions or leads generated through their referral link. This includes tracking the transactional data of both the user and the referring company/affiliate. This helps us evaluate and optimize our referral programs. The transactional data may be collected directly from the referring company or affiliate as part of this process.
• Special Offers and Personalized Promotions: To offer you personalized promotions, discounts, or special offers based on your preferences, purchasing behavior, or other personal information provided during your interaction with the Site. This could include tailoring our marketing efforts to suit your interests and needs. Additionally, we may use data from the referring company or affiliate, along with your interaction on our site, to provide targeted offers and promotions that are relevant to you.
• To Improve User Experience: To analyze and improve the content, functionality, and performance of the Site.
• Administrative Purposes: To ensure internal quality control and safety; authenticate and verify individual identifies, including requests to exercise your rights under this Privacy Policy; debug to identify and repair errors with our Site and services; conduct audits relating to interactions, transactions, and other compliance activities; enforce our agreements and policies; and for other legitimate business purposes unless otherwise prohibited by law.
• With Your Consent: We may use personal information for other purposes for which you provide consent.
• For Other Purposes: We also use your personal information for other purposes as requested by you or as permitted by applicable law, including to create de-identified and/or aggregated information. If we de-identify your personal information, we publicly commit to retain and use the de-identified personal information without attempting to re-identify the de-identified personal information.

We will not sell, rent, or lease your personal information to third parties. However, we may disclose your personal information to trusted third parties in the following cases:

• Service Providers: We may disclose your personal information with third-party vendors or service providers who assist in operating the Site or provide services to you (e.g., payment processors, email marketing platforms) or us.
• Referral Partners and Affiliates: We may disclose certain personal information (such as referral source and transactional data from both the user and the referring company/affiliate) with referring companies, affiliates, or partners for the purpose of tracking and crediting referrals and managing our referral program. This includes disclosing the transactional data that is tied to both the user and the referring affiliate or company, including any performance-based or commission data. This transactional data may be collected directly from the referring company or affiliate.
• Legal Compliance: We may disclose your personal information if required to do so by law, such as to comply with a subpoena or similar legal process, or if we believe such action is necessary to protect the rights, property, and safety of PERQS Member, our customers, or others.
• Event of Merger, Sale, or Other Asset Transfers: We may disclose your personal information If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, as part of such a transaction, as permitted by law and/or contract.

To the extent that we disclose your personal information, we may disclose any of the above categories of personal information to any of the above described third parties for any business or commercial purpose. We have no actual knowledge of selling of sharing the personal information of anyone under 16 years of age.   

4. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to collect personal information about your interactions with the Site. This allows us to improve your experience and track usage patterns. Cookies are small files that are stored on your device and browsers that store preferences and facilitate and enhance your experience. You can choose to accept or decline cookies through your browser settings.

5. Your State Privacy Rights and Choices

• Access/Know/Confirm: You may have the right to request access to the personal information we hold about you. You may be able to request a list of specific third parties to which we have disclosed your personal information.

• Request Deletion: You can request that we delete your personal information, subject to applicable legal obligations.
• Opt-out of E-Mail Marketing Communications: You can unsubscribe from marketing emails at any time by clicking the “unsubscribe” link at the bottom of our emails.
• Opt-Out of Sales or Sharing for Cross-Contextual Advertising: You may opt out of the sale or sharing (as such term is defined under applicable law) of your personal information for cross-contextual behavioral advertising. Such opt-out right may be available through an opt-out preference signal.
• Opt-Out of Targeted Advertising or Profiling: You may opt out of the use of your personal information for targeted advertising or profiling that produce legal effects or effects of similar significance. Such opt-out right may be available through an opt-out preference signal.  With regards to profiling, you may also be able to question the results of the profiling and ask to be informed of the reasons for a profiling decision. You may also have the right to review the personal information used in profiling and have the personal information corrected and reevaluated if it was determined to be inaccurate.
• Revoke Consent: You may be able to revoke a previously provided consent for the processing of your personal information. 
• Non-Discrimination and Non-Retaliation: You will not be discriminated or retaliated against for exercising your privacy rights.
• Appeal: You may be able to appeal the decisions we make in response to your privacy requests.

An authorized agent may submit a request on your behalf.  A parent or guardian may also submit a request on behalf of a child.

6. How We Protect Your Personal Information

We take reasonable security measures to protect the personal information you provide to us. This includes the use of encryption and secure data storage practices. However, no method of data transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee the absolute security of your personal information.

By using the Site or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Site. If we learn of a system’s security breach, we may attempt to notify you electronically by posting a notice on our Site, by mail, or by sending an email to you.

7. Third-Party Websites

Our Site may contain links to third-party websites that are not controlled or operated by us. This Privacy Policy does not apply to third-party websites. Please note that this Privacy Policy does not govern the collection and use of personal information by companies that we do not control, nor by individuals not employed or directly managed by us. Any such third-party may have practices that differ from us.  We do not claim nor accept responsibility for any privacy policies, practices, and/or procedures of other such websites. We encourage you to review the privacy policies of any third-party websites you visit. We do not endorse or authorize any of the privacy and security practices conducted by other websites, nor are we liable for any privacy practices of those websites.

8. Children’s Privacy

Our Site is not intended for individuals under the age of 13 (or other age as required by local law). We do not knowingly collect personal information from children under the age of 13. If we become aware that we have inadvertently collected such information, we will take steps to delete it, unless we have a legal obligation to keep it. If you believe your child has provided us with personal information, please contact us to remove it.

9. Retention of Personal Information

We store the personal information we collect as described in this Privacy Policy for as long as you use the Site, or as necessary to fulfill the purpose(s) for which it was collected, provide the Site, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws, or based upon other criteria, including, but not limited to, the sensitivity and volume of such data. We endeavor to retain and dispose of all such personal information in accordance with reasonable industry standards.

We may update this Privacy Policy from time to time reflect changes in our practices, legal requirements, or the functionality of the Site. We will notify you of any material changes as required by applicable law, such as by posting the updated Privacy Policy on this page with a revised “Last Updated / Effective Date.” If you continue to access the Site after the new Privacy Policy has taken effect, we will assume you have read and acknowledged the new terms.
